145.A.85 requires the organisation to notify the competent authority of any proposed changes that affect the basis of the approval, including changes to the accountable manager, facilities, scope of work, or any other element that could impact the organisation's ability to comply with Part 145.
What it means in practice
Any significant change to the organisation must be notified to the competent authority before the change takes effect. This includes changes to the accountable manager, quality manager, or other nominated post holders; relocation of facilities; changes in the scope of work; changes to subcontracting arrangements; and any other change that could affect the organisation's ability to comply with Part 145.
The purpose is to ensure the competent authority can assess whether the changed organisation still meets the approval requirements. Some changes may require prior approval before implementation, while others may be notified and implemented subject to acceptance by the authority.
Key requirements
The organisation must have a procedure to identify which changes require notification to the competent authority. Changes to the accountable manager require prior approval from the competent authority. Other changes affecting the terms of approval must be notified and may require an amendment to the approval certificate. The MOE must be amended to reflect any change, and the relevant MOE amendments must be submitted as required.
The organisation must not implement changes that affect the basis of its approval without the appropriate level of notification or approval from the competent authority.
Common compliance gaps
Organisations sometimes make changes incrementally without recognising that the cumulative effect constitutes a significant change requiring notification. For example, gradually expanding into a new type of work, moving equipment between facilities, or increasing reliance on subcontractors may individually seem minor but collectively alter the basis of the approval. Failure to notify changes to nominated post holders in a timely manner is also a common finding.
