147.A.90 establishes the conditions under which a Part 147 approval remains valid, including the requirement for continued compliance with Part 147 and for granting the competent authority access to the organisation.
What it means in practice
A Part 147 approval remains valid as long as the organisation continues to meet all applicable requirements, the MTOE remains acceptable to the competent authority, and the organisation grants the competent authority access to its facilities, records, and personnel for oversight purposes. If any of these conditions are not met, the approval may be suspended, limited, or revoked.
The organisation must also respond to findings raised by the competent authority within the specified timeframes. Failure to address findings, particularly Level 1 findings that indicate a significant non-compliance, can lead to suspension or revocation of the approval.
Key requirements
The organisation must maintain continuous compliance with Part 147. It must grant the competent authority unrestricted access for oversight. The MTOE must be kept current and acceptable to the competent authority. All findings must be addressed within the corrective action timeframes specified by the competent authority.
Common compliance gaps
Organisations sometimes allow findings to remain open beyond the agreed corrective action deadlines, risking escalation and potential suspension. Another common issue is a failure to maintain the MTOE as a living document, resulting in significant discrepancies between documented and actual procedures.
