147.A.95 defines the process for findings issued by the competent authority, including the classification of findings into Level 1 and Level 2, and the corrective action requirements for each level.

What it means in practice

When the competent authority identifies non-compliance during an audit or inspection, it issues a finding. Level 1 findings indicate a significant non-compliance that lowers the safety standard and seriously hazards flight safety. Level 2 findings indicate a non-compliance that could lower the safety standard and could possibly hazard flight safety. The organisation must develop and implement corrective actions within specified timeframes.

For Level 1 findings, the competent authority may take immediate action including suspension or limitation of the approval. Level 2 findings allow the organisation a defined period to develop and implement a corrective action plan, but if the finding is not resolved within this period, it may be escalated to Level 1.

Key requirements

The organisation must have a procedure for receiving, analysing, and responding to findings. Corrective actions must address the root cause, not just the immediate non-compliance. Level 1 findings require immediate corrective action. Level 2 findings must be corrected within the timeframe agreed with the competent authority, typically not exceeding three months.
